MomoX3 is charting and market-analysis software provided at app.momox.io and via desktop builds. Market data is retrieved using your own data-provider credentials (e.g. Alpaca, Schwab); we pass it through without storing your credentials and are not the source of, and not responsible for, that data's accuracy or availability. Full-market real-time data additionally requires free accounts with third-party providers (currently Alpaca and Schwab, including Schwab's Trader API access). Providers approve, deny, delay, suspend, or terminate access at their sole discretion and on their own timelines; their decisions are outside our control, are not a failure of the service, and are not grounds for a refund — the software remains functional on the base data feed.
Subject to payment and these terms, you receive a personal, non-exclusive, non-transferable, revocable license for one named individual to use MomoX3. All software, code, designs, algorithms, signals, visualizations and branding remain the exclusive intellectual property of Clark Trading LLC. No rights are granted except the limited use license in this section.
Plans and installment purchases. Some offerings (for example "AscensionX Lifetime") may be sold as a fixed-term installment plan — e.g. twelve monthly installments of $200 (US $2,400 total) — alongside a separate base MomoX3 subscription. A "lifetime" entitlement vests only when every scheduled installment has been paid. If an installment is missed and not recovered, or any payment is charged back or disputed, the unvested entitlement — including any associated community roles — may be revoked, and amounts already paid are not refundable except as required by law. Installment plans end automatically after the final scheduled payment and do not renew; any accompanying base subscription (e.g. $2.99/month) is a separate, ongoing subscription with its own billing, and a vested lifetime entitlement does not replace it unless we say so in writing.
You agree not to, and not to help anyone else to:
• Share access — credentials, sign-in links, license keys, or active sessions
are for you alone; simultaneous-use limits are enforced technically and contractually.
• Copy or redistribute the software or any part of it, including saved copies of
the application, in any form.
• Reverse engineer, decompile, scrape, or extract the software, its signal logic,
or its outputs, including automated collection of signals or data for use outside the app.
• Build competing or derivative products using the software, its code, or
systematic observation of its outputs.
• Frame, embed, mirror, or resell the service or access to it.
• Probe, disrupt, or circumvent — no security testing, rate-limit evasion,
session-limit circumvention, or interference with the service or other users.
• Automate access — no bots, headless clients, or programmatic use of the
application outside its intended interface.
Every session is individually fingerprinted and watermarked, and we log technical signals (including device, session, and coarse location activity) to detect sharing and abuse. You consent to this monitoring. We may suspend or terminate access immediately and without refund for violations of Section 3, and pursue any other available remedy. Leaked or redistributed copies are traceable to the originating account.
Liquidated damages for shared access. Lost subscription revenue from shared access is real but difficult to measure precisely, so you agree that unauthorized use of your access by any additional person will be invoiced at the then-current individual monthly subscription price, per additional person, per month or part-month of shared use — as liquidated damages representing a reasonable pre-estimate of our loss, not a penalty. Termination does not waive our right to recover these or any other damages.
Enforcement costs. If we prevail in an action to enforce these terms, you agree to pay our reasonable costs of enforcement and collection, including attorneys' fees.
MomoX3 provides charts, indicators, and informational signals. Nothing in the service is investment, financial, legal, or tax advice, nor a recommendation to buy or sell any security. Markets involve substantial risk of loss. You alone are responsible for your trading decisions and their outcomes. We are not a broker-dealer or investment adviser.
Subscriptions bill through Stripe until canceled; you can cancel anytime and retain access through the paid period. Except where required by law, payments are non-refundable: canceling stops the next renewal and does not refund the current period — though if a renewal charged after you had already asked to cancel, or you believe you were billed in error, contact support@momox.io within 14 days of the charge and we'll make it right. Lapsed or refunded subscriptions lose access automatically. You are responsible for the security of your email account, which functions as your sign-in. Beta access, where granted, is provided free, "as is", may change or end at any time, and feedback you provide may be used freely by us.
We run two separate reward programs. Referral rewards ("give $25, get $25"): when a friend subscribes through your referral code, they receive the stated discount on their first payment and you receive an account credit after that payment clears. One reward per referred customer; credits apply only to your MomoX3 billing, have no cash value, and are not transferable. No self-referral — referring yourself, an account you control, or any purchase you fund voids the reward.
The affiliate program pays cash commissions on qualifying sales and is run through our affiliate platform. Participation is at our discretion and may be declined or ended at any time. Commission rates, attribution windows, and payout timing are those published in the affiliate dashboard and may change prospectively. Only offers we designate as commissionable earn commissions; internal or promotional carts we mark non-commissionable never do.
No self-dealing; one reward per sale. Commissions are not earned on your own purchases or on purchases you fund or control. A single sale earns at most one reward across both programs — a referral credit or an affiliate commission, never both — and we resolve attribution conflicts in our sole discretion. Refunds, chargebacks, disputes, and fraud reverse the associated credit or commission, and payouts may be withheld while a sale is under review.
Promotion conduct. No misleading or unsubstantiated claims (including income or trading-performance claims), no spam, no cookie-stuffing or forced clicks, no bidding on our trademarks, and no holding yourself out as MomoX3. Violations forfeit unpaid commissions and end participation. Affiliates are independent contractors — not employees, agents, or partners — and are responsible for their own taxes; payout-provider processing or withdrawal fees may apply per the payout platform's published terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THE ACCURACY OF ANY MARKET DATA OR SIGNAL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARK TRADING LLC'S TOTAL LIABILITY ARISING FROM THE SERVICE IS LIMITED TO THE FEES YOU PAID IN THE TWELVE MONTHS BEFORE THE CLAIM, AND WE ARE NOT LIABLE FOR TRADING LOSSES OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You will indemnify and hold harmless Clark Trading LLC from claims, damages, and costs (including reasonable attorneys' fees) arising from your violation of these terms or misuse of the service.
These terms are governed by the laws of the State of Wyoming, USA, with exclusive venue in its courts. If a provision is unenforceable, the rest remain in effect. We may update these terms; material changes take effect on your next sign-in, and the current version is always at app.momox.io/terms. These terms are the entire agreement regarding the service.
